🚨 How Evernest Kansas City Violated Rental Licensing Laws

📂 Here’s what the evidence shows:
The owner and management company never filed for a rental license before my tenancy.
I was forced to request an inspection due to their inaction, which led to the landlord finally applying for a rental license.
The landlord applied but failed to meet the requirements and never completed any repairs to bring the property into compliance.
On October 15, 2024, Evernest received a 2-page violation report detailing serious habitability issues.
As of February 17, 2025, Evernest has not repaired or resolved any of these violations.
Due to the violations, the city denied the rental license, meaning the unit was never legally rentable.
Despite this, Evernest still rented out the property and collected rent, violating Kansas rental laws.

Key Violations Committed by Evernest Kansas City

1. Renting Out an Unlicensed Property

Evernest rented out 520 Sandusky Ave without obtaining a valid rental license—a direct violation of K.S.A. 58-2559, which states that a landlord cannot legally collect rent for an unlicensed unit.

📌 Evidence:

  • Rental License Denial (09/24/24) – Confirms Evernest did not complete the licensing process.
  • Final Rental License Denial (01/27/25) – Unified Government officially rules that this property cannot be rented or occupied.

💡 This means tenants who paid Evernest may be entitled to a refund of rent payments.

2. Renting an Unsafe, Uninspected Unit

Before receiving a rental license, a unit must pass an inspection. Evernest failed to meet basic safety standards but still leased the unit anyway.

📌 Inspection Violations Found at 520 Sandusky:
⚠️ Active water leaks and mold
⚠️ Electrical hazards & missing smoke detectors
⚠️ Unstable floors and structural damage
⚠️ Broken plumbing fixtures

📌 Evidence:

💡 Evernest was fully aware of these issues and still rented out the property.

3. Retaliating Against Tenants for Reporting Unsafe Conditions

Kansas law protects tenants from retaliation if they report a property for violations. Instead of fixing the problems, Evernest tried to evict tenants who spoke out.

📌 Evidence:

  • Court Summons (12/27/24) – Evernest attempted to evict a tenant from a rental that was already denied a license.
  • Tenant Reports – Previous tenants also reported similar treatment.

💡 If you experienced this, you have legal grounds to fight back.
